Evergreen Settlements (“Evergreen,” “we,” “us” or “our”), a Pennsylvania company, operates several websites, including this website (each a “Site” and collectively, the “Sites”). By using or accessing this Site, a mobile application of this Site, or any of the Site’s Content (as defined below), you acknowledge that you agree to and are subject to the following terms and conditions of service (the “Terms”). If you do not fully agree to these Terms, you may not access or otherwise use the Site. You should read through all the Terms carefully. The Terms constitute a legally binding agreement between you and Evergreen as the owner or operator of the Site. You covenant, represent, and warrant that you have any and all authorizations necessary to enter into this agreement and that your use of the Site, including provision or use of any Content, does not violate any applicable law. If you are using the Site on behalf of an employer or other entity, you represent and warrant that you have the authority to bind such entity to these Terms. You must be a resident of the United States (including its territorial possessions) and at least eighteen (18) years of age to access and use the Site. THESE TERMS CONTAIN AN AGREEMENT TO ARBITRATE ALL CLAIMS, A WAIVER OF YOUR ABILITY TO BRING OR PARTICIPATE IN ANY CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION, AND DISCLAIMERS OF WARRANTIES AND LIABILITY. IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE NOT AUTHORIZED TO ACCESS OR USE THE SITE OR THE SERVICES OFFERED AND SHOULD EXIT THE SITE IMMEDIATELY. Evergreen does not offer to sell or buy insurance or other products described on the Site. Instead, the Site acts as a venue that allows agents, marketing partners, finders, and other insurance-related entities (“Providers”) to market insurance, life settlements, and related products to consumers (“Prospects”). Evergreen may collect information submitted by Prospects (“Leads”) and provide such Leads to Providers. Evergreen does not endorse or recommend any Provider, insurance policy, product, or service and does not provide insurance, tax, legal, or financial advice. Providers may require additional information before providing quotes or offers, and Evergreen does not guarantee acceptance, pricing, or response from any Provider. Availability of products and services may vary by state and may change without notice. By submitting information through the Site, you consent to being contacted by Evergreen and matched Providers via phone, text, or email, including autodialed or prerecorded communications, even if your number is listed on a Do Not Call registry, and you acknowledge that message and data rates may apply. All information you submit must be accurate and complete. Evergreen grants users a limited, revocable, non-exclusive license to access the Site for personal, non-commercial use in accordance with these Terms. Unauthorized copying, scraping, framing, modification, distribution, reverse engineering, or misuse of the Site or Content is strictly prohibited. Evergreen may modify or discontinue the Site or any portion thereof at any time without notice. Use of the Site signifies your agreement to Evergreen’s Privacy Policy. Data may be stored or processed in the United States regardless of your location. Evergreen does not verify the identity of all users and is not liable for unauthorized use of accounts. THE SITE AND ALL CONTENT AND SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, AND EVERGREEN SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, WITH TOTAL LIABILITY LIMITED TO $100. You agree to indemnify and hold harmless Evergreen and its affiliates from claims arising out of your use of the Site. Disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, with a waiver of class actions, unless you timely opt out as provided. These Terms are governed by the laws of the Commonwealth of Pennsylvania. Evergreen may amend these Terms at any time, and continued use constitutes acceptance of such changes. Evergreen respects intellectual property rights and complies with the DMCA. The Site may contain links to third-party websites, which are not controlled by Evergreen, and Evergreen assumes no responsibility for such sites. You should retain a copy of these Terms for your records. Miscellaneous provisions include limitations on claims, severability, survival of terms, and assignment rights reserved to Evergreen.
